Please read these Terms carefully. By registering, posting an advertisement, contacting another user or otherwise using adspage.ie, you agree to these Terms. If you do not agree, do not use the website.
1. WHO WE ARE
1.1 adspage.ie ("Ads Page", "we", "us", "our") is operated by [COMPANY NAME], a company registered in Ireland under company number [NUMBER], with its registered office at [REGISTERED ADDRESS].
1.2 Contact: [CONTACT EMAIL]. This is also our single point of contact for users and for authorities under the EU Digital Services Act. We communicate in English.
2. WHAT ADS PAGE IS – AND IS NOT
2.1 Ads Page is a free online classified advertising platform. We provide a space where users ("Advertisers") can publish advertisements and other users ("Buyers") can view them and contact Advertisers.
2.2 Ads Page is NOT a party to any transaction between users. We do not buy, sell, own, possess, inspect, store, deliver or guarantee any item, property, vehicle, animal, job or service advertised on the website. Any contract is made directly and only between the Buyer and the Advertiser.
2.3 We do not act as an agent, broker, auctioneer, employer, recruiter, estate agent, motor dealer or escrow service for any user.
2.4 We do not handle payments between users. We never ask users to pay for items through Ads Page, and we do not offer any "Ads Page protected payment", "Ads Page delivery" or similar service. Any message claiming otherwise is a scam.
2.5 We do not verify the identity of users or the accuracy, legality, quality, safety or ownership of anything advertised.
3. ELIGIBILITY AND ACCOUNTS
3.1 You must be at least 18 years old to register, post advertisements or buy or sell through Ads Page.
3.2 You must provide accurate information and keep it up to date. You must not register using another person's identity or contact details.
3.3 You are responsible for keeping your password secure and for all activity on your account. Tell us immediately at [CONTACT EMAIL] if you believe your account has been used without your permission.
3.4 Businesses and traders who advertise must clearly identify themselves as a business in their advertisements and comply with all consumer protection law that applies to them, including the Consumer Rights Act 2022.
4. YOUR RESPONSIBILITIES AS AN ADVERTISER
4.1 You are solely responsible for your advertisements and everything you post, including text, photos, prices and contact details.
4.2 You confirm that:
(a) you own, or are legally entitled to sell or offer, what you advertise;
(b) your advertisement is accurate, complete and not misleading, including the condition, price and any faults;
(c) the item or service is legal to sell, supply and own in Ireland;
(d) you have the right to use every photo and piece of text you upload; and
(e) you will honour any sale you agree to and deal honestly with Buyers.
4.3 You must comply with all laws that apply to your advertisement and sale, including consumer, tax, animal welfare, employment, property and vehicle laws.
5. PROHIBITED CONTENT AND ITEMS
You must not post, offer or request:
(a) anything illegal, stolen, counterfeit or replica goods, or goods that infringe anyone's intellectual property;
(b) weapons, firearms, ammunition, explosives or items designed to cause harm;
(c) drugs, controlled substances, prescription-only medicines, or tobacco and alcohol sold in breach of the law;
(d) adult, sexual or escort services, or sexually explicit material;
(e) animals or pets in breach of animal welfare or breeding laws, or protected species;
(f) hazardous, recalled or unsafe products;
(g) personal data, ID documents, bank cards, accounts or log-in details;
(h) pyramid schemes, "get rich quick" offers, loans or financial products offered without the required authorisation, gambling or lotteries;
(i) jobs that are unpaid "deposit" schemes, require upfront payment from applicants, or break employment law;
(j) fake, duplicate, misleading or "bait" advertisements, or advertisements for items you do not have;
(k) content that is hateful, discriminatory, harassing, threatening, defamatory or obscene;
(l) spam, chain messages, links to malware or phishing sites; or
(m) anything else we reasonably consider unsuitable for Ads Page.
6. SCAMS, FRAUD AND SAFE TRADING
6.1 Ads Page cannot guarantee that any user is genuine or honest. You use the website and deal with other users AT YOUR OWN RISK and you are solely responsible for your own decisions.
6.2 To protect yourself:
- Meet in person in a safe, public place and see the item before paying.
- Never pay a deposit, delivery fee, "holding fee" or "release fee" for something you have not seen.
- Never pay by bank transfer, money transfer service, gift card, voucher or cryptocurrency to someone you have not met.
- Never share your bank, card, PPS, passport or log-in details, or one-time security codes.
- Be very wary of prices that are too good to be true, sellers who are "abroad", "in the army" or "away", and anyone who pressures you to act quickly.
- Check vehicle history and ownership before buying a vehicle. Never pay a deposit on a rental property you have not viewed.
- Ignore emails or messages claiming to be from Ads Page asking you to pay, confirm a payment or "release" funds. Ads Page does not process payments.
- Only continue a conversation that started on Ads Page through channels you trust.
6.3 If you think you have been scammed, contact your bank immediately and report it to An Garda Síochána. Please also report the advertisement or user to us at [CONTACT EMAIL] so we can act.
6.4 We will co-operate with An Garda Síochána and other lawful authorities and may share information with them as permitted by law and our Privacy Policy.
7. REPORTING CONTENT AND HOW WE MODERATE
7.1 Anyone can report an advertisement or user they believe is illegal, fraudulent or breaches these Terms, using the "Report" option on the advertisement or by emailing [CONTACT EMAIL]. Please include the link to the advertisement, why you believe it is illegal or breaches these Terms, and your name and email address (except for reports concerning child sexual abuse material).
7.2 We review reports promptly, diligently and objectively. We may use a combination of automated tools and human review.
7.3 We may, at our discretion and without prior notice where the law allows: refuse, edit, hide or remove any advertisement; limit its visibility; suspend or close an account; or block access to the website, where we reasonably believe content is illegal, fraudulent, misleading or breaches these Terms.
7.4 Where we remove or restrict your content or account, we will tell you why, unless the law prevents us or the content is deceptive high-volume commercial content (spam). You may ask us to review our decision by replying to that notice or emailing [CONTACT EMAIL]. You may also use any out-of-court dispute settlement body certified under the EU Digital Services Act, or go to court.
7.5 We may suspend users who frequently post clearly illegal content, or who frequently submit clearly unfounded reports, after first warning them.
7.6 We are under no general obligation to monitor content, and the fact that an advertisement appears on Ads Page does not mean we have checked or approved it.
8. FREE SERVICE AND PAID UPGRADES
8.1 Posting a standard advertisement on Ads Page is free.
8.2 We may offer optional paid upgrades, such as Featured, Priority, Urgent or Highlighted advertisements. The price, duration and what each upgrade includes are shown before you pay.
8.3 Paid upgrades increase the visibility of an advertisement only. They do NOT guarantee any number of views, contacts or a sale, and they do not mean we have checked or endorse the advertisement or the Advertiser.
8.4 Upgrades start as soon as payment is confirmed. If you are a consumer, you agree that the service begins immediately, and you acknowledge that you lose your 14-day right to cancel once the upgrade has been fully provided. Upgrades are not refundable if your advertisement is removed for breaching these Terms. This does not affect your statutory rights.
9. YOUR CONTENT AND OUR RIGHTS
9.1 You keep ownership of the content you post. You grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, display, resize, watermark and promote your content on Ads Page and our social media and marketing channels for as long as it is on Ads Page and for a reasonable time afterwards.
9.2 The Ads Page name, logo, website design and software belong to us or our licensors. You must not copy, scrape, harvest or re-use any part of the website, its listings or user contact details, including by automated means, without our written permission.
10. ACCEPTABLE USE
You must not:
(a) use Ads Page to send unsolicited messages, spam or phishing messages, or to collect other users' contact details;
(b) contact Advertisers to offer unwanted services or for any purpose other than a genuine enquiry about their advertisement;
(c) use bots, scripts or other automated means to post, search, contact users or access the website;
(d) interfere with or try to gain unauthorised access to the website, its servers or other users' accounts; or
(e) create multiple accounts to get around a suspension or posting limits.
11. LIMITATION OF OUR LIABILITY
11.1 Ads Page is provided free of charge "as is" and "as available". We do not promise that the website will always be available, uninterrupted, secure or error-free, or that any advertisement will result in a sale.
11.2 Because we are not a party to any transaction between users, to the fullest extent permitted by law we are NOT responsible or liable for:
(a) any advertisement, message or other content posted or sent by users;
(b) the existence, quality, safety, legality, condition or ownership of anything advertised;
(c) the truth or accuracy of any advertisement, or the identity, honesty or ability to pay of any user;
(d) any fraud, scam, theft, deception, non-payment, non-delivery, injury, damage or loss arising from dealings between users, whether online or in person; or
(e) any loss of profit, business, opportunity, data or goodwill, or any indirect or consequential loss.
11.3 To the fullest extent permitted by law, our total liability to you for any claim connected with Ads Page is limited to the greater of (i) the amount you paid us for paid upgrades in the 12 months before the claim, and (ii) €50.
11.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Irish or EU law. If you are a consumer, nothing in these Terms affects your statutory rights.
11.5 Any dispute about a transaction is between the Buyer and the Advertiser. You agree not to make any claim against Ads Page in relation to such a dispute, except where the law gives you that right.
12. INDEMNITY
If you are acting for business purposes, you agree to compensate Ads Page and [COMPANY NAME] for any claims, losses, costs (including reasonable legal costs) and penalties arising from your advertisements, your dealings with other users, or your breach of these Terms or of the law.
13. PRIVACY
We process personal data in accordance with our Privacy Policy, available at [PRIVACY POLICY LINK], and the General Data Protection Regulation. Your contact details may be shown to other users when you post an advertisement or reply to one. Do not include more personal information in your advertisements than you are comfortable sharing publicly.
14. CHANGES AND TERMINATION
14.1 We may change these Terms from time to time, for example to reflect changes in the law or to our services. We will post the updated Terms on the website with a new date and, for significant changes, notify registered users by email or on the website. If you continue to use Ads Page after the changes take effect, you accept the updated Terms.
14.2 You may close your account at any time. We may suspend or close accounts and remove content in line with section 7.
14.3 We may change, suspend or discontinue all or part of Ads Page at any time.
15. GENERAL
15.1 These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of Ads Page.
15.2 If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect.
15.3 If we do not enforce a right straight away, we have not given it up.
15.4 These Terms are governed by the laws of Ireland. The courts of Ireland have jurisdiction over any dispute, except that, if you are a consumer living in another EU country, you may also bring proceedings in your home country and keep the protection of its mandatory consumer laws.
